NHS trust providing mental health services for Maldon district to be prosecuted by HSE

THE Health and Safety Executive (HSE) is prosecuting the NHS trust that provides mental health services for the Maldon district area.

The HSE has announced that it is to prosecute Essex Partnership University NHS Foundation Trust (EPUFT) over management of the risks posed by "fixed potential ligature points" in its inpatient wards between 25 October, 2004, and 31 March, 2015. Such points could provide possible places for patients to attempt suicide through hanging.

The case against the current trust (EPUFT) is because it replaces North Essex Partnership University NHS Foundation Trust (NEPUFT), the trust that was investigated over this matter.

EPUFT, based at The Lodge in Lodge Approach, Runwell, will face a charge under Section 3(1) of the Health and Safety at Work Act 1974.

Commenting on the HSE announcement, EPUT chief executive Sally Morris, said:

"As legal proceedings have started, we are restricted in the comments we can make, but I would like to take this opportunity to say our thoughts and deepest sympathies are with the families whose loved ones were part of this investigation.

"Safety is our absolute priority and we are continually working to ensure the safest environment possible for our patients."

The first hearing is due to take place on 12 November 2020 at Chelmsford Magistrates' Court.
