Applications received

1. Wicke Pin, 9 Katonia Avenue, Mayland CM3 6AD

Application for non-material amendment following grant of Planning Permission 20/00713/HOUSE (Amendments sought to previous planning permission 20/00070/HOUSE (Demolition of existing conservatory and erection of rear extension, front and rear dormer roof alterations and front porch) including:

  • Patio door width increased
  • Front window changed from bay window to flush window
  • Roof lights to extension, formation and sizes revised
  • Utility external door repositioned slightly
  • Rear dormer revised to match front dormer size
  • Front dormer - the area of the dormer between the windows revised to have pitch roofs (to match those over windows) and vertical tiled sections changed to render
  • Porch roof changed from flat to pitch with render gable

Amendment sought: To extend the rear dormer towards the back of the property to give more floor space.

2. 47 North Street, Maldon CM9 5HJ

Replace the front door and bathroom window to the front. Replace concrete block wall with brick to the front, repair brick wall to the side and erect a batten fence. Remove shrubs to the front and replace with brick wall. Remove full length windows and replace with timber boarding on the rear elevation and removal of door to the rear. Replace bathroom windows to the side elevation and install a roof light on the single storey flat roof to the side. The W/C to the front first floor to be converted to an additional bedroom/office.

3. The Computer Centre Probe House 106 Station Road Burnham-On-Crouch CM0 8HR

Change of use from vacant first floor office and attic space to a single, one bedroom first-floor flat.

Bellway Homes: Reserved matters application for the approval of access, appearance, landscaping, layout & scale for the construction of 262 residential units with associated access, parking, servicing and landscaping (Phase 2 only) on approved application 15/00419/OUT (Part outline/part detailed (hybrid) application for mixed use development including:

  • Residential development (Use Class C3) for up to 1138 dwellings including 30% as affordable housing (Outline)
  • Residential Care for up to 120 beds (Use Class C2) (Outline)
  • "Neighbourhood" uses which may include retail, commercial, and community uses (Use Classes A1 and/or A2 and/or A3 and/or A4 and/or A5 and/or D1a and/or D1b) (Outline)
  • Primary school and early years childcare facility (Use Class D1c) (Outline)
  • A relief road between Broad Street Green Road and Langford Road (Detailed element)
  • Formal and informal open space (including any associated sports pavilion/clubhouse) (Use Class D2e) (Outline)
  • Construction of initial gas and electricity sub-stations (Detailed)
  • All associated amenity space, landscaping, parking, servicing, utilities (other than as listed above), footpath and cycle links, on-site drainage, and infrastructure works (Outline).

2. 42A Colchester Road, Great Totham CM9 8DG

Application to vary conditions on approved planning permission 20/01278/FUL (Proposed splitting of dwelling/offices to form two semi-detached houses, conversion and extension of existing garage to form three-bedroom detached house (following outline application 18/01035/OUT) and associated works)

3. Land North of Latchingdon Bowls Club, Burnham Road, Latchingdon

Variation of condition 2 on approved Planning Permission 16/00299/FUL (Full planning application for (1) the development of 41 homes, amenity space and a revised vehicular access from the Burnham Road, and (2) a new village hall and associated infrastructure, (no change is proposed to the existing village hall access) Amendment sought: Substation added, Material change to window cills, include solar panels to the roof, include air source heat pumps.

Applications refused

1. The Othona Community, East End Road, Bradwell-on-sea CM0 7PN

An application for the erection of a wind turbine of up to 32 metres - overall height to tip.

Reasons for refusal:

  • The development, as a result of the height, size and position of the wind turbine proposed, would be a visually incongruous element within this flat, open, rural, coastal landscape to the detriment of the character and appearance of the area, contrary to Policies S8, D4 and D1 of the approved Maldon District Local Development Plan and the NPPF.
  • The development, as a result of its nature, size and position, would have an adverse impact on the use of public footpath no.15 Bradwell-on-Sea, contrary to Policies T1, T2 and D4 of the approved Maldon District Local Development Plan and the NPPF.
  • There is insufficient information provided for the local planning authority to be able to conclude that the development would not have an adverse impact on the designated sites (Dengie SPA, Ramsar and SSSI), European Protected Species (Great Crested Newts) and protected species (bats), contrary to Policies S1, S8, D4, N1 and N2 of the approved Maldon District Local Development Plan and the NPPF.
  • It has not been demonstrated that the development would not cause harm to the setting of the highly graded heritage assets in the vicinity of the site, including the scheduled monument known as 'Saxon Shore fort and Anglo-Saxon monastery at Bradwell-on-Sea' (List Entry Number 1013834) and the grade I listed 'Chapel of St Peter on the Wall' (LEN. 1110942), contrary to Policies D3 and D4 of the approved Maldon District Local Development Plan and NPPF.

2. Land at The Red Lion Inn, 47 The Street, Latchingdon

An application erection of two 1.5 storey residential dwellings.

Reason for refusal:

The proposed development does not include any alterations to a listed building, and as such, listed building consent cannot be granted. This is in accordance with Section 66 (1) of the Planning (Listed Buildings and Conservation Areas) Act 1990.

3. Land south of Wycke Hill and Limebrook Way, Maldon

Taylor Wimpey: Variation of condition 1 (approved drawings) on approved planning permission 18/00531/RES (Approval of reserved matters (layout, scale, appearance and landscaping) for Phase 1 of the Eastern Parcel of the wider Land South of Wycke Hill and Limebrook Way site (LPA Application Ref. FUL/MAL/18/00071), comprising the construction of 200 residential dwellings (Use Class C3) and associated works.) Amendment sought: relocation of 16 trees from the Fambridge Road frontage to the public open space within the site and change to type of five trees within public open space

Reason for refusal:

The amendments proposed to the approved details of the replacement hedgerow along the Fambridge Road boundary of the site would cause harm to the character and appearance of the area, contrary to Policies S2, S3, S4, S8, D1 and H4 of the Local Development Plan and the NPPF.
